Filing Fees by Chapter
Chapter 7: $338. Chapter 13: $313. Chapter 11: $1,738. Chapter 12: $278. These are court filing fees only -- they do not include attorney fees.
Fee Waivers
Chapter 7 filers whose household income is below 150% of the federal poverty guidelines may qualify for a fee waiver. File an Application to Have the Chapter 7 Filing Fee Waived (Official Form 103B) with your petition. The court will review and grant or deny the waiver.
Installment Payments
If you cannot pay the full fee at filing but do not qualify for a waiver, you can request to pay in installments. File an Application for Individuals to Pay the Filing Fee in Installments (Official Form 103A). The court typically allows 4 installments over 120 days.
Attorney Fees
Chapter 7 attorney fees typically range from $1,000 to $3,500 depending on the district and complexity. Chapter 13 attorney fees range from $2,500 to $6,000 and are often paid through the plan. Always ask for the total cost upfront, including filing fee, attorney fee, and any additional charges.
